These Terms of Service (“Terms”) govern your use of the website located at ercapitalpartner.com (the “Site”), operated by ER Capital Partners, LLC (“ER Capital Partners,” “we,” “us” or “our”). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1. Business-Purpose Lending Only
ER Capital Partners makes loans for business and investment purposes only, secured by non-owner-occupied real estate. We do not offer consumer loans or loans for personal, family or household purposes. By submitting a loan request you represent that the loan proceeds will be used solely for business or investment purposes.
2. No Offer or Commitment to Lend
Information on the Site, including rates, terms, leverage, closing timelines, program descriptions, case studies and calculator results, is provided for general information only and is subject to change without notice. Nothing on the Site is an offer, commitment or guarantee to lend. Any loan is subject to our underwriting, property valuation, due diligence, satisfactory documentation and final credit approval, and will be governed solely by the executed loan documents.
3. Use of the Site
You agree to use the Site only for lawful purposes. You may not:
- submit false, misleading or fraudulent information;
- attempt to gain unauthorized access to the Site, our systems or other users’ information;
- interfere with the Site’s operation, including by introducing malware or automated scraping; or
- use the Site in violation of any applicable law or regulation.
4. Information You Submit
You are responsible for the accuracy and completeness of information you submit. By submitting a form, you authorize us to contact you by phone, email or text message about your request and to verify the information you provide, including, with your separate authorization, by obtaining credit and background reports. 5. Calculators and Estimates
Payment calculators and estimates on the Site are illustrations based on the assumptions you enter. They do not include all costs, such as taxes, insurance, escrows, servicing fees, third-party fees or prepayment terms, and are not a loan quote. Actual terms are stated only in a written term sheet and final loan documents.

The Site and its content, including text, graphics, logos, images and software, are owned by ER Capital Partners or its licensors and are protected by copyright and trademark laws. You may view and print content for your personal, non-commercial use. You may not copy, modify, distribute or create derivative works without our prior written consent.

11. Governing Law and Venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.
12. Changes to These Terms
We may revise these Terms at any time by posting the updated version on the Site. Your continued use of the Site after changes are posted means you accept the revised Terms.
