Fair Lending & Anti-Discrimination
Last Updated: October 15, 2026
ER Capital Partners, LLC is committed to fair lending. We make credit decisions based on the merits of each transaction and the creditworthiness of each borrower, and we treat all applicants fairly and equally.
1. Equal Credit Opportunity
In accordance with the Equal Credit Opportunity Act (ECOA) and its implementing Regulation B, we do not discriminate against any applicant on the basis of race, color, religion, national origin, sex (including sexual orientation and gender identity), marital status, or age (provided the applicant has the capacity to enter into a binding contract); because all or part of the applicant’s income derives from any public assistance program; or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act.
2. Fair Housing
We support the Fair Housing Act and do not discriminate in residential real estate-related transactions on the basis of race, color, religion, sex, handicap (disability), familial status or national origin. We also comply with applicable state and local fair lending and anti-discrimination laws, which may protect additional characteristics.
3. Consistent Underwriting
Our underwriting decisions are based on objective, documented criteria, including property value and condition, loan-to-value or loan-to-cost ratios, the borrower’s real estate experience, liquidity, credit history and the viability of the exit strategy. We apply our criteria consistently to all applicants, and pricing exceptions are documented and reviewed.
4. Training and Oversight
Our team members receive fair lending training. We periodically review our marketing, underwriting, pricing and servicing practices, and those of our brokers and vendors, to identify and correct any potential disparate treatment or disparate impact.
5. Broker and Partner Expectations
We expect mortgage brokers, referral partners and vendors who work with us to comply with all fair lending laws. We will end relationships with partners who engage in discriminatory practices.
6. Reporting a Concern
If you believe you have been treated unfairly, please contact our compliance team. Concerns may also be reported to the Consumer Financial Protection Bureau (consumerfinance.gov), the U.S. Department of Housing and Urban Development (hud.gov) or the federal agency that administers compliance with the ECOA for ER Capital Partners, the Federal Trade Commission, Washington, DC 20580.
