Borrower Rights
Last Updated: October 15, 2026
At ER Capital Partners we believe every borrower deserves clear terms, honest communication and fair treatment. This page summarizes what you can expect from us throughout the life of your loan. It is not a substitute for your loan documents, which govern your loan.
1. Transparent Terms
Before you commit, you will receive a written term sheet showing the loan amount, interest rate, term, origination points, fees, reserves and prepayment terms. Your loan documents will state every cost of the loan. We do not add undisclosed fees at closing.
2. Clear Communication
You will have a dedicated loan manager who keeps you informed of your loan’s status, required documents and expected closing date. You may ask questions at any stage and receive a timely response.
3. Review Your Documents
You have the right to review your loan documents in advance of closing and to have them reviewed by your own attorney or advisor. We encourage you to do so.
4. Fair and Equal Treatment
You have the right to be evaluated on the merits of your transaction without discrimination. We do not discriminate on the basis of race, color, religion, national origin, sex, marital status, age (provided the applicant has capacity to contract), receipt of public assistance income, or the good-faith exercise of rights under the Consumer Credit Protection Act. See our Fair Lending Policy.
5. Notice of Action Taken
If we decline your loan request or approve it on different terms than you requested, we will notify you and, upon written request made within 60 days, provide the specific reasons for our decision, as required by the Equal Credit Opportunity Act.
6. Privacy of Your Information
Your personal and financial information is used only to evaluate and service your loan and is protected as described in our Privacy Policy. We do not sell your information.
7. Draws and Servicing
For loans with construction or renovation holdbacks, we will explain the draw process, inspection requirements and expected funding timeline in writing. You will receive statements showing payments applied, interest charged and your remaining balance, and you may request a payoff statement at any time.
8. Hardship and Default
If you anticipate difficulty making a payment or completing your project, contact us as early as possible. We will discuss available options in good faith. Before exercising remedies for default, we will provide the notices required by your loan documents and applicable law.
9. Complaints and Concerns
If you have a concern about how your loan was handled, please contact our compliance team. We will acknowledge your complaint promptly, investigate it and respond in writing. You may also contact the appropriate state regulator or the Consumer Financial Protection Bureau.
